Privacy Policy

1. The two kinds of personal data we handle

Because MemberEmber is a business-to-business platform, we handle personal data in two different roles, and your rights depend on which one applies to you:

• Account Data - information about you if you are a website visitor, a staff member or owner at a Customer organization, or a subscriber to our newsletter. We decide how this data is used, and this Policy describes that use directly.
• Contact Data - information a Customer uploads about its own lapsed members, sponsors, donors, or attendees (name, email, business affiliation, membership history) so MemberEmbercan research and email them on the Customer's behalf. Here, we act as a service provider processing data under the Customer's instructions, not as the decision-maker. If you are a contact in someone's uploaded list and have questions about how your information is used, please contact that organization directly; we will assist them in honoring your request.

2. Account Data we collect

• Account & billing: name, work email, organization name, and subscription/billing details processed through ThriveCart.
• Sending account connections: OAuth tokens or API credentials for the email account you connect (Gmail, Outlook, or another supported provider), stored encrypted at rest and used solely to send and read mail on your behalf.
• Usage data: how you use the dashboard - campaigns created, settings changed - to operate and improve the service.
• Site visitor data: pages visited and, only if you consent under our Cookie Policy, cookies used for analytics.
• Communications: messages you send us, such as support requests or demo inquiries.

3. How we use Account Data

• To provide, maintain, and secure the platform and your account.
• To process billing through ThriveCart and send transactional email (welcome emails, notifications, alerts) through Resend.
• To respond to support requests and, if you've opted in, send our newsletter (see Newsletter Terms).
• To detect abuse, enforce our Terms of Service, and comply with legal obligations.

4. How Contact Data is used

Contact Data a Customer uploads is used only to provide the service to that Customer: researching contacts (Ember Check™), generating personalized outreach drafts and hooks, sending email through the Customer's own connected account, and classifying replies. Contact Data is never shared with, or visible to, any organization other than the Customer who uploaded it - every query in our system is scoped to a single organization by design. We do not sell Contact Data, and we do not use it to train models for any purpose beyond providing the service to that Customer.

5. Artificial intelligence & research

To generate research summaries and email drafts, relevant Contact Data is sent to our AI provider (Anthropic) and, for the research phase, to a web search provider, solely to produce that output for the Customer. These providers process the data as our subprocessors and are contractually restricted from using it for their own purposes such as model training, per their business/API terms.

6. Subprocessors and service providers

We share data with the following categories of service providers, only as needed to operate MemberEmber:

• Hosting & database: Vercel (application hosting) and Neon (database hosting).
• Authentication: Clerk, for account sign-in and organization management.
• AI processing: Anthropic, for research summaries, email drafting, and reply classification.
• Web research: our search provider, used only during the Ember Check™ research phase.
• Background job processing: Inngest, which schedules and runs multi-step workflows like sending and reply polling.
• Email delivery: your own connected Gmail/Outlook/ESP account for outreach; Resend for our own transactional platform email.
• Payments: ThriveCart, for subscription billing and license management.

We do not sell personal data, and we do not share it with third parties for their own advertising purposes.

7. Data security

Sending-account credentials are encrypted at rest. Every database query is scoped to the requesting organization so one Customer can never see another Customer's data. Access to platform administration is limited to authorized personnel. No system is perfectly secure, and we cannot guarantee absolute security.

8. Data retention

We retain Account Data for as long as your account is active and as needed to comply with legal, tax, or billing obligations after that. Contact Data is retained for as long as the uploading Customer's account is active, and is deleted or returned within a reasonable period after that Customer's account is closed and any legally required retention period has passed.

9. Your rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal data, and to object to or restrict certain processing. California residents have additional rights described in our California Privacy Rights page. To exercise a right, contact us using the details below; we may need to verify your identity before acting on a request.

10. Children's privacy

MemberEmber is a business tool and is not directed to, and does not knowingly collect personal data from, children under 16.

11. International visitors

MemberEmber is operated from, and its data is hosted in, the United States. If you access the service from outside the United States, your information will be transferred to and processed in the United States.

12. Changes to this Policy

We may update this Privacy Policy from time to time. Material changes will be reflected by an updated Effective Date at the top of this page.
